This Legal Notice governs the use of the My Care CRM website and services (collectively referred to as the "Platform"), an NDIS Customer Relationship Management system operating in Australia.
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Legal Notice and all applicable Australian laws and regulations. If you do not agree with any part of these terms, you must not use the Platform.
All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of My Care CRM or its licensors and are protected by Australian and international intellectual property laws.
My Care CRM is committed to protecting your privacy and complying with the Privacy Act 1988 (Cth), Australian Privacy Principles, and NDIS Quality and Safeguards Commission requirements. Our collection, use, storage, and disclosure of personal and sensitive information is outlined in our Privacy Policy, which forms part of this Legal Notice.
Our Platform is designed to assist NDIS service providers in meeting their obligations under the National Disability Insurance Scheme Act 2013 (Cth) and associated regulations. However, the responsibility for compliance with NDIS requirements remains with the service provider using our Platform.
To the maximum extent permitted by law, the Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. My Care CRM does not warrant that the Platform will be uninterrupted, error-free, or free from harmful components.
To the extent permitted by Australian law, My Care CRM shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the Platform.
You agree to indemnify, defend, and hold harmless My Care CRM, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from your use of the Platform or violation of this Legal Notice.
My Care CRM reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time. We may also revise this Legal Notice from time to time. The revised terms will be effective from the date of posting.
This Legal Notice shall be governed by and construed in accordance with the laws of Australia. Any dispute arising under this Legal Notice shall be subject to the exclusive jurisdiction of the courts of Australia.
If any provision of this Legal Notice is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render this Legal Notice unenforceable or invalid as a whole.
